* Sonny Lopez Shot And Killed By SWAT Team In Cupertino

The murder suspect, who was shot and killed by Fremont S.W.A.T. officers in Cupertino, has been identified by the Santa Clara County Coroner’s Office as Sonny Lopez, 34. On Sunday, March 7, at approximately 10 a.m., the Fremont Police Department and Santa Clara County Sheriff’s Office launched a joint high-risk operation in an effort to apprehend a homicide suspect, who was wanted by Fremont Police for shooting and killing his uncle on Monday, March 1. Lopez was also a possible suspect in the murder of a 96 year-old victim in Saratoga. Through the course of investigation, Fremont detectives learned that the suspect was staying at an apartment complex on the 10000 block of Miller Avenue in Cupertino. At approximately 2 p.m., a team of Fremont S.W.A.T. officers saw Lopez leave the apartment complex on foot. The officers, who were in full tactical police uniform, confronted the suspect and identified themselves as police officers. When Lopez, who was armed with a handgun, fled from the officers, a foot pursuit ensued and several shots were fired. The suspect subsequently died at the scene. This case is being investigated by the Santa Clara County Sheriff’s Office.

The Mountain View Police Department is currently seeking Jose Cruz Zamora-Padilla on a No Bail Allowed warrant charging him with alleged child molest. Detective Kevin Solomon reports that on February 5th 2010, Padilla allegedly sexually assaulted an 8 yr old girl on California Street. Padilla was last known to be employed at the Sheraton Hotel located at 625 El Camino Real, Palo Alto. He was also last known to be living in the 5400 block of Eagles Lane in San Jose. It is possible that Padilla may have fled to Mexico and he will later return to the bay area. Santa Cruz Police Detectives have identified Jorge Huante as the suspect in an armed robbery at Sylvan Music on Tuesday March 2, 2010. Detectives followed up on a number of leads, including a cell phone that was dropped by the suspect as he was fleeing the crime. The cell phone was recovered and turned over to the store by neighborhood resident. In addition to this robbery, Mr. Huante was also identified as the suspect in a string of crimes dating back to February 20, 2010. The details are as follow:

* On February 20, 2010, Mr. Huante entered the Valero gas station at 2202 Mission Street. Mr. Huante waited in line with other customers. When he reached the front of the line, Mr. Huante used a ruse to get the clerk to open the register. Mr. Huante then reached over the counter and took the cash drawer from the register. Mr. Huante had to struggle with the clerk to gain control of the cash drawer. He was eventually successful and was able to get away with the drawer. Mr. Huante was identified by officers that viewed video surveillance of the crime.

* On March 1, 2010, Mr. Huante entered the Offshore Music Store at 926 Soquel Avenue. Mr. Huante showed particular interest in a bass guitar. Eventually, Mr. Huante grabbed the guitar and fled the store to an awaiting getaway car. Mr. Huante yelled threats at the employees as they pursued him. Mr. Huante was eventually traced to the getaway car which was registered to another person associated with Mr. Huante.

* On March 2, 2010, Mr. Huante entered the Sylvan Music Store at 1521 Mission Street. Mr. Huante asked about a particular vintage electric guitar. Mr. Huante left the store and returned shortly afterwards armed with a handgun. Mr. Huante took the guitar from the store at gunpoint.

Mr. Huante should be considered armed and dangerous. His string of crimes is increasing in brazenness and aggression. Additionally, Mr. Huante has armed himself with a handgun while committing his latest crime. The Santa Cruz Police Department has obtained a warrant for Mr. Huante’s arrest charging Armed Robbery and Grand Theft. The warrant has a bail amount of $100,000. District Attorney Dolores Carr announced today she will not file charges against San Jose police officers for alleged excessive force used to arrest suspect Phuong Ho.

Mar 3, 2010 SAN JOSE DA WON’T FILE CHARGES AGAINST OFFICERS IN PHUONG HO CASE

The Santa Clara County District Attorney’s Office today announced that charges will not be filed against four officers involved in the violent arrest of San Jose State University student Phuong Ho last September. At a news conference this morning, District Attorney Dolores Carr said there was insufficient evidence to convict Officers Kenneth Siegel, Steven Payne Jr., Jerome Smith and Gabriel Reyes. The officers were captured on a cell phone camera using a baton and Taser stun gun to control and arrest Ho, a 21-year-old Vietnamese exchange student, at San Jose State University on Sept. 3, 2009. The officers had responded to a report of a man brandishing a knife at one of his roommates at their home in the 100 block of South 23rd Street.Ho suffered minor injuries and was arrested following the confrontation. A criminal investigation was launched into the officers’ conduct after the video surfaced.
The district attorney’s office concluded its investigation on Feb. 19 and four days later dismissed misdemeanor charges against Ho, of brandishing a deadly weapon and resisting, delaying or obstructing a peace officer. Glenn Miller, an attorney for Ho, said dismissing those charges was “the right thing to do” and that all Ho wants to do now is return to an
anonymous life.Carr and Supervising Deputy District Attorney Lane Liroff, who investigated the case, announced their decision and released the results of the investigation, bound in a thick, comprehensive report.Carr said she believes a jury would not convict the officers based on the evidence. She said that conclusion was based on a $20,000 investigation by a
team of experts comprised of former police officers, who evaluated forensic analysis of the baton, an enhanced version of the cell phone video, and interviewed witnesses.”This was a very difficult case to evaluate,” she said, adding, “There are details we still cannot reconcile completely.”Carr said one of the challenges in the case was receiving contradictory witness statements and evaluating a poor-quality video. She said the investigation did prove, however, that Ho’s accusations that several officers used a baton were false and that two of the three experts believe use of force was justified. “A jury would find that 13 baton strikes in 45 seconds was reasonable,” Carr said, adding that the baton strikes were intermittent and
ceased after Ho was handcuffed.Carr also briefly alluded to an incident three months prior to the September confrontation in which Ho was involved in a violent argument with a roommate. Liroff said that although he found the video difficult to comprehend because of its poor quality, he realized it was the key to the investigation and hired a crime scene analyst to enhance the quality and create slides simulating Ho’s position throughout the two-minute, 15-second video. Liroff also discussed the legality of use of force by police, stating that although it depends on reasonableness, “reasonableness is an inexact yardstick.”He said the officers in this incident had probable cause to arrest Ho and that by law, Ho had to submit to the arrest. Miller said he was not involved in the criminal investigation, but that by mid-April plans to file a lawsuit against the city of San Jose seeking $6 million for violation of Ho’s civil rights.

Reedley Police Officer Javier Bejar was taken off of life support today and died. Officer Bejar was the 1st police officer to die in the 100 year history of the Reedley Police Department. He was shot by a crazed gunman armed with an AR-15 rifle, as he responded to help Fresno sheriff’s deputies that had been shot by the same gunman. Fresno Deputy Joel Wahlenmaier died from his wounds and Deputy Mark Harris was wounded. Over 25 police officers and sheriff’s deputies engaged the gunman in a massive gun battle with over 500 rounds exchanged.
