On May 2, 2024 at approximately 9:00 pm, Patrol Officers responded to an ice cream shop located at the 2900 block of Aborn Square for a report of an assault, vandalism and child abuse that occurred days prior. Upon arrival, Officers discovered that on April 26, 2024, at about 5:30 pm, an unknown male suspect smashed a window directly where a young child was sitting inside the ice cream shop. This caused large shards of glass to fall on the young child. The child and child’s guardian left the ice cream shop after this incident occurred.

The San José Police Department Assaults Unit detectives immediately began a comprehensive and extensive investigation into the incident. Detectives identified the suspect as Payam Afsari and obtained a warrant for his arrest.

On May 15, 2024, with the assistance of the SJPD Street Crimes Unit, the suspect was located at his residence in the city of San José. The suspect was taken into custody and booked into the Santa Clara County Main Jail for assault with a deadly weapon and child abuse charges.
