Two Xenia Police officers have been placed on administrative leave following a police-action shooting on Sunday that left one person injured. The suspect, identified as Kyle Berry, has been released from Miami Valley Hospital and taken into custody, according to an update released by police on Tuesday afternoon.
On June 30, 2024, at 7:25 a.m., Xenia-Greene Central Communications received a 911 call reporting a man shooting a gun in the parking lot of an apartment complex near 190 Bellbrook Avenue and pointing the weapon at the caller. Upon arrival, Officers 1 and 2 encountered the suspect, identified as 23-year-old Kyle Berry, rounding the corner of the apartments and aiming his gun at the Xenia Police. The apartment manager, who was in the parking lot, ran into the apartment building for safety.
As Officer 3 exited his cruiser, he commanded Berry to drop his gun. Berry did not comply, and as Officers 1 and 2 approached, he pointed his weapon at them. The officers fired shots, injuring Berry. A Kimber semi-automatic pistol was recovered from the scene. Berry was transported to the hospital for medical attention and has since been released to the Greene County Jail.
During his Wednesday arraignment in Xenia Municipal Court, Berry’s bail was set at $500,000 for two counts of felonious assault. Police stated that Berry might face additional charges once the case is presented to a county grand jury.

On June 30, 2024, at 0725hrs, Xenia Police Division Officers were dispatched to the area of 190 S. Orange St. Xenia, Greene County, OH reference a male subject shooting a gun.
The caller stated that they heard gunshots outside and later observed a male subject, later identified as Kyle Berry, holding a gun. The caller also stated that Berry pointed the gun In his direction and “tried to shoot”. The caller stated that Berry lives in one of the apartments at 190 S.Orange St.
The first Xenia Officers arrived on scene and saw Berry holding a handgun. When additional officers arrived, they saw Kyle Berry holding a handgun and pointing it at the other Officers.
Xenia Officers fired their service weapons, striking Berry. Officers recovered a handgun near Berry.
Xenia Officers then provided medical care until paramedics from the Xenia Fire Division arrived on scene. Xenia Fire Division paramedics transported Berry to the Miami Valley Hospital.
On July 2, 2024, Berry was released from the Miami Valley Hospital. He was taken into custody and is being booked into the Greene County Jail. Berry is being charged with one count of Felonious Assault (victim is a peace officer), 2903.11(A2), a felony of the first degree and one count of Felonious Assault, 2903.11(A)(2), a felony of the second degree. Berry will be arraigned in the Xenia Municipal Court on a later date. Additional charges may be filed once the case is presented to the Grand Jury.

On June 30, 2024 at approximately 7:25 a.m., Greene Central Communications received a complaint about a subject who had been shooting a pistol in the area of 190 Bellbrook Ave. The caller also indicated that the subject had pointed the pistol at the caller.
Xenia Police Division Officers responded to the area to investigate the complaint. When they arrived on scene, they located the suspect outside of the apartment complex. Shortly after the Officers arrived on scene, shots were fired and the suspect was injured. The suspect was taken to the Miami Valley Hospital for treatment.
The Ohio Bureau of Criminal Investigation (BCI) has been asked to conduct the criminal investigation. The Xenia Police Division will continue to cooperate with BCI and the Greene County Prosecutor’s Office as they conduct their investigation.

As a routine procedure common to officer-involved shootings, two Xenia Police Division Officers have been placed on administrative leave. One of the Officers has 16 years of law enforcement experience and the second Officer has ten years of law enforcement experience. The Officers shall remain on administrative leave until further notice.
